Moderation rules for Dealer Reviews
We check all reviews before publishing them. Knowing what's allowed will give you the best chance of ensuring your review is passed the first time.
Consumers have the opportunity to share their views about their retail experience with a particular dealer (“Review(s)”). The relevant dealer who is the subject of the Review (“the Dealer”) also has the ability to submit a response to the Review (“Reply” or “Replies”). The Reviews and Replies will be published on Buy and Hire website, subject to full compliance with these Rules.
By submitting a Review to us, you accept and agree to abide by these Rules. We check all Reviews before publishing them. Knowing what is allowed will give you the best chance of ensuring your Review is passed the first time. Vehicle reviews submitted to the item reviews service on the Buy and Hire Platform are subject to separate rules.

1. Your eligibility to submit a Review
1.1 By submitting a Review to us, you represent and warrant that:
a. the Review complies with these Rules b. you are not the Dealer or engaged or employed by the Dealer; c. you do not have any personal or business affiliation with the Dealer or dealership, past or present; d. you will maintain the e-mail address that you have registered with us; e. you are 18 years of age or older; and f. you are not subject to any on-going court proceedings or police investigations in connection with the Dealer.
1.2 The Dealer Review Service is for your personal use only and is not to be used for any commercial purposes including, without limitation, to advertise goods and/or services.
1.3 You must not use a Review to attempt to solicit the personal details of another person.

2. You are responsible for the content of your Review
2.1. All Reviews submitted to us are moderated and subject to automated checks to assess the authenticity of the Review before we publish them on the Buy and Hire Platform. This moderation and automated check process may be undertaken by a third party on our behalf.
2.2. Notwithstanding clause 2.1 above, you are solely responsible for the content of any Review that you submit. Buy and Hire does not accept any responsibility or liability for the content of any Review published on the Buy and Hire Platform and we expressly exclude our liability for any loss or damage that you or any third party suffers or incurs in connection with the content of your Reviews and/or your use of the Dealer Reviews service and/or Buy and Hire Platform in contravention of these Rules.
2.3 We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors and for fraud or fraudulent misrepresentation.

3. Our rights to publish your Review

a. displayed on the Buy and Hire Platform, provide it complies with these Rules and our Content Standards for Dealer Reviews and satisfies our automated checks; b. included within notifications to the Dealer who is the subject of the Review; and c. visible within the particular Dealer’s review management portal.
3.2 Any Review you transmit to us shall be considered and treated by us as non-confidential.
3.3 By submitting a Review to us: a. you grant to us a non-exclusive licence to freely use, edit, alter, reproduce, publish, sub-licence and/or distribute the material contained in your Review. This licence is free of charge and continues indefinitely. To the extent permitted by law, you waive your right to be identified as the author of any Reviews and your right to object to any derogatory treatment of any Reviews; and b. you warrant that you have the right to grant to us the licence described in clause 3.3a above.

4. Privacy
4.1 Any personal information you provide to us in the course of submitting your Review will be treated in accordance with our Privacy Notice.
4.2 We will not publish your personal information, such as full name or email address, unless you choose to include this as part of your Review. This is solely at your discretion.

5. Our rights if you breach these Rules
5.1 Where we consider, at our sole discretion, that a breach of these Rules and/or the Content Standards for Dealer Reviews has occurred and/or that the Dealer Review Service is being used in a manner that we consider to be inappropriate, we may take such action as we deem appropriate which includes (without limitation) the following action, with or without notice:
a. the immediate, temporary or permanent removal of any or all Reviews submitted by you; and/or b. immediate, temporary or permanent withdrawal of your registration to the Buy and Hire Platform.
5.2 We will not be liable to you for any loss or damage that you suffer or incur in connection with any action we may take in response to a breach of these Rules. The actions we may take are not limited to those described above, and we may take any other action we reasonably deem appropriate.
5.3 You agree to reimburse us for any and all losses, liabilities, claims and expenses (including reasonable legal expenses) suffered or incurred by us in connection with any Review submitted by you.

5.3 You agree to reimburse us for any and all losses, liabilities, claims and expenses (including reasonable legal expenses) suffered or incurred by us in connection with any Review submitted by you.
6. Review enquiries
If you have a query regarding any Review or Reply on the Buy and Hire Platform, please contact us at [email protected] and give us as much information as possible as to why you think the Review or Reply should be removed from the Buy and Hire Platform. We will review your enquiry as soon as possible and take any action that we deem appropriate in the circumstances.
7. Changes to these Rules
We reserve the right to make changes to these Rules at any time. Every time you wish to submit a Review, please check these Rules to ensure you understand the terms that apply at that time.
8. General
8.1 These Rules contain the entire agreement between us and you and govern your use of the Dealer Reviews services.
8.2 We may transfer, subcontract or delegate our rights and obligations under these terms to any third party, provided this does not adversely affect your rights under these terms.
